Orthomom Lawsuit Update

Paul Alan Levy of Public Citizen, the attorney representing me in the Pamela Greenbaum/Google/Orthomom lawsuit has filed an Opposition to Petition for Discovery. Find all 37 pages of the brief here (PDF).

    it's really a great brief. Very thorough and I can't imagine how someone could have anything left to argue after reading this.

    Feder will be completely outlawyered by Levy and not just because Levy is a better lawyer. Its because Levy dealt with this particular issue many times before, but Feder probably has not. To write a brief like this from scratch requires endless hours of legal research. However, Levy had dealt with many factually similar cases in the past, so this is largely a cut and paste job, where he copies from his old briefs to his new ones. Feder probably has not dealt with this issue before, and he will not have the time to draft a great brief on this matter.

    This is why; when one is looking for an attorney, try to find someone who is as close to a specialist in the area one is dealing with as possible.

    It's a well argued brief, I hope the judge finds the arguments compelling.

    Also nice to see how Google looks at these things. Although this article focuses on the recent $1B viacom suit, I found it interesting how the article quotes a Google representative who mentions blogging as well.

    in my opinion this lawsuit was a ploy on two fronts
    1. try to expose orthomom without telling her(if not for daily news, om may not have known, and google may have given her up)

    2. rally pam constituents to vote.

    Paul Levy is an idiot. I especially take issue with his use of tired phrases when trying to make a point. To quote George Orwell (who wrote phrases that have not been used to death):

    "This mixture of vagueness and sheer incompetence is the most marked characteristic of modern English prose, and especially of any kind of political writing. As soon as certain topics are raised, the concrete melts into the abstract and no one seems able to think of turns of speech that are not hackneyed: prose consists less and less of words chosen for the sake of their meaning and more and more of phrases tacked together like the sections of a prefabricated henhouse." ("Politics and Language," 1946).

    If I read "if you can't stand the heat..." or "chilled free speech," one more time, ..........

    Uhu... he's just another idiot attorney who has argued numerous first amendment cases successfully before the Supreme Court and Court of Appeals and is widely respected as one of the most preeminent attorneys nationwide in this area.

    If there's one thing that's crystal clear this silly lawsuit, PAM AND HER CLOWN HAVE BEEN OUTSMARTED AND OUTLAWYERED.
